Discriminating is often illegal and there are steps that can be taken to stop the discrimination and/or harassment that you may be suffering from.

In the workplace discrimination can often occur if your employer takes action against you for a range of prohibited reasons, including your age, race, religion, sexual orientation or gender identity, or as a result of disability.

If you think you may have been discriminated against, you may be entitled to make a claim either under various discrimination acts, equal opportunity legislation or under employment legislation, such as the Fair Work Act 2009 such as:

  • Age Discrimination Act 2004;
  • Australian Human Rights Commission Act 1986;
  • Disability Discrimination Act 1992;
  • Racial Discrimination Act 1975;
  • Sex Discrimination Act 1984; or
  • Equal Opportunity Act 1984.
